The Department of Homeland Security (DHS) revealed that on September 7, 2025, Beto Cerillo‑Bialva—a Mexican national living in the U.S. without legal status—was arrested and charged with murder after he drove intoxicated into a tree, killing six passengers and gravely injuring another. Because of his criminal history, U.S. Immigration and Customs Enforcement (ICE) had previously placed a detainer requesting local authorities to inform ICE before releasing him. However, California, under Governor Gavin Newsom, reportedly does not recognize ICE detainers.

Following a third DUI arrest in 2024, ICE had again issued a detainer, but California authorities ignored it. Cerillo‑Bialva, according to the DHS, has been deported from the U.S. seven times—an action that counts as a felony—and carries a long record of offenses including possession of cocaine, multiple DUI convictions, driving without a license, and violation of a protective order tied to domestic abuse.

DHS Assistant Secretary Tricia McLaughlin strongly criticized California’s policies, accusing the state and Governor Newsom of enabling this tragedy. She argued that sanctuary laws shield dangerous criminals, and asserted that this case could have been avoided if local authorities had cooperated with ICE. She pledged that “ICE will do everything in our power” to remove Cerillo‑Bialva from the country.
