A political action committee established by tech entrepreneur Elon Musk has been formally reprimanded by the Georgia State Election Board after it mailed pre-filled absentee ballot applications to voters ahead of the 2024 election.
The group, known as America PAC, was the subject of an investigation designated as case SEB2024-151. Founded in 2024, the PAC reportedly saw Musk invest approximately $250 million into its political efforts that year. Concerns were raised by election officials in several Georgia counties, including Chattooga County, Cherokee County, Coweta County, Floyd County, and Whitfield County.
According to the board’s findings, the mailings violated a section of Georgia election law — specifically statute 21-2-381 — which governs the proper formatting and markings required on absentee ballot applications. While the board did not specify all the details of how the forms were completed in advance, Executive Director James Mills described them as being “partially” pre-filled when summarizing the case during the meeting.
Dr. Janice Johnston, vice chair of the State Election Board, stated that the evidence indicated America PAC breached state law by distributing absentee ballot applications that were already filled out in part. She also said the organization failed to prominently display the legally required disclaimer stating that the mailing was not an official government publication, was not provided by a government entity, and was not itself a ballot.
Following a brief discussion lasting about four minutes, the board voted unanimously by voice vote to issue a letter of reprimand to the PAC. Such letters are a routine disciplinary measure when the board determines that election rules have been violated but do not warrant more severe penalties.
The matter was taken up Wednesday during the first day of the board’s two-day monthly meeting, which was held this week in Barrow County.
