Kilmar Abrego García, a 30-year-old Salvadoran national, was released from jail in Tennessee last Friday only to be informed by ICE that he could be deported to Uganda within 72 hours—a startling turn in his immigration saga. This notification came immediately following his release from custody in Tennessee and in defiance of his desire to await trial in the United States.

Background of the Case
Abrego was previously deported to El Salvador in March despite a court order protecting him due to well-founded fears of gang-related violence. The Supreme Court, however, ultimately mandated his return to the U.S., which occurred in June. Upon his return, he was charged with human smuggling based on a 2022 traffic stop in Tennessee. He has pleaded not guilty.
He lives in Maryland with his U.S. citizen wife and children and was granted pretrial release under strict conditions, including electronic monitoring and reporting to the ICE field office in Baltimore.

Plea Offer vs. Deportation Threat
A plea proposal was extended: plead guilty and be deported to Costa Rica, where he would face no detention. Abrego rejected this offer. Within minutes of his release, ICE notified his lawyers of the Uganda deportation plan and ordered him to check in at their Baltimore office by Monday morning—effectively removing the Costa Rica option.

Legal and Ethical Concerns
Abrego’s defense portrays this as an act of government retaliation and coercion, accusing the Trump administration of pressuring him into a plea by threatening deportation to a country where he has no ties and faces potential danger. They argue that Uganda poses a significant safety risk and that the offer of Costa Rica was rescinded simply because he chose not to plead.

A judge has previously ordered that ICE must provide 72 hours’ notice prior to deportation to a third country, a directive ICE appears to have followed.
