James Comey case: Ex-special counsel John Durham undercut case against James Comey in interview with prosecutors: Sources

John Durham, who was once special counsel investigating how the FBI began its 2016 probe into possible Russia ties, told prosecutors in Virginia that his years of work turned up no credible evidence that former FBI Director James Comey committed false statements or obstruction. 

In August, Virginia federal prosecutors met with Durham to review what his investigation had found. They also reviewed work from Washington, D.C., where another team that had looked into Comey—calling him to testify before a grand jury in 2021—couldn’t identify any prosecutable wrongdoing. 

After its own two‑month inquiry, the Virginia team concluded similarly—not only that it wouldn’t be possible to prove Comey deliberately misled Congress, but also that there was no probable cause to charge him. They laid this out in a formal memo. 

Despite those findings, Lindsey Halligan, the U.S. Attorney in the Eastern District of Virginia appointed by Trump, pushed ahead with an indictment. Last month, a grand jury returned an indictment charging Comey on two counts—making false statements to Congress and obstruction—though they declined a third count that had been sought. 

Durham’s lack of evidence for false statement or obstruction charges adds a layer of complication: his findings could serve as a potential cornerstone for Comey’s defense.
