Two criminal illegal aliens involved in the attempted armed robbery and shooting of an off-duty U.S. Customs and Border Protection (CBP) officer in Fort Washington Park, NYC, were both previously released into the U.S. under the Biden Administration and protected by NYC’s sanctuary policies, despite extensive criminal histories and final deportation orders.
Suspects:
Cristian Aybar Berroa (Dominican Republic):

Illegally entered the U.S. on June 19, 2022; released pending immigration hearing.

Final removal order issued: January 3, 2023.

Despite ICE detainers, NYC authorities repeatedly released him after multiple arrests:

May 2023: Reckless endangerment.

March & April 2024: Two arrests for felony grand larceny and petit larceny.

Feb 2025: Reckless endangerment, reckless driving, unlicensed driving.

June 2025: Pled guilty to petit larceny; conditionally discharged.

Miguel Francisco Mora Nunez (Dominican Republic):

Illegally entered U.S. on April 4, 2023; released by federal authorities.

Final removal order issued: November 6, 2024.

Arrested multiple times:

Oct 2023: Felony grand larceny, reckless driving.

Oct 2024: 2nd & 3rd degree assault.

Nov 2024 & Jan 2025: Criminal contempt.

Feb 2025: Armed robbery warrant (MA).

Incident (July 19, 2025):

Both suspects approached the CBP officer and a woman while armed.

During the attempted robbery, the CBP officer defended himself and was shot in the arm and face.

Nunez, the shooter, was arrested first; Berroa followed soon after.
Reaction:

Assistant Secretary Tricia McLaughlin criticized NYC’s sanctuary policies for ignoring ICE detainers and allowing violent offenders to remain free, saying these policies continue to endanger lives and public safety.
